Mission Statement

Top of the World ATV Club Inc., is the ATV Club in the town of Concord. We are a non-profit organization that is affiliated with Vermont All Terrain Vehicle Sportsman’s Association Inc., (VASA). Our goal is to provide safe and responsible operation of ATV’S on town roads and private land, where the owner’s allow us to ride. We want to provide scenic trails in our town that will show the beauty of our town and make loops so you do not have to turn around and back track. We also want to connect to neighboring towns to eventually have a trail system as extensive as is for snowmobiles in the state. There are 16 other VASA clubs in Vermont; eventually we want to connect our trail systems. While working to do this, we all seek and support the preservation and protection of our natural environment. We as a club are ready to render both ourselves and ATV’s to help public service in case of an emergency or disaster.

Top of the World ATV Club By-Laws
 

The name of this non-profit organization will be known as and called Top of the World ATV Club. (TOW ATV Club.) Per some landowners request we will be a VASA affiliated club.

  1. This club is organized for charitable & educational purposes, along with safe & responsible enjoyment for it's members.

  2. This club will maintain a close relationship with appreciation for and recognition of the landowners that allow us to ride on their land.

  3. This club will encourage courteous, lawful & responsible use of ATV's.

  4. This club will actively seek and support the preservation & protection of our natural environment.

  5. This club will promote the development of recreational areas for the use of ATV's.

  6. This club will render to public service in the case of an emergency and/or disaster.

  • Definition of All-Terrain Vehicle (ATV)- Means any non-highway recreational vehicle, except snowmobiles and dirt bikes.

  • Any person interested in ATV recreation may become a member of Top of the World ATV Club, upon proof of registration and the payment of club membership and VASA at the same time. Those who don't own an ATV, may just join the club.
  •  
  • Shall the numbers of members in this club drop to fewer than 5 this club shall cease to exist. Upon dissolution and & all assets monetary and otherwise will be donated to another organization within the town of Concord.

  • From this time forward paid members are only allowed to vote on club issues. If more than one machine is registered in the club (family membership) all family members 16 years and older who reside at home may vote, and must be listed on the club roster.

  • The Board of Officers will set membership dues annually. At this time being $15.00 for the 1st machine, $5.00 for each additional machine (family membership). You will need to provide registration information for each machine receiving a sticker.

  • Officers will be elected yearly at the 1st annual meeting of the year. If a position becomes vacant we will elect someone to fill that position for the remaining term at the next monthly meeting.

  • It will be the responsibility of the President to be the Chief Executive Officer of the organization. He/She will chair & preside at all meetings of the club. The President may appoint the members of any/all committees. He/She shall sign all documents requiring an official signature.

  • It will be the responsibility of the Vice President to perform the duties of the President in an absence or incapacity of the President. The Vice President will serve as Chair of the Trails Committee.

  • It will be the responsibility of the Secretary to keep accurate records of members & activities. Also, to issue notices of the club meetings and coorespondence.

  • It will be the responsibility of the Treasurer to keep accurate records of all monies allocated to the club, and will supervise the disbursement of the funds subject to the approval of the board.

  • Monthly club meetings will be conducted for the purpose of: Introducing new ideas with the request for the President to appoint committees for such requested activities. Evaluate reports of completed activities and projects and make suggestions for improvement.

Rules and Regulations

  • Alcohol & Drugs are strictly prohibited on or at any club functions or affairs.

  • All members under the age of 18 will be required to wear a helmet while riding on trails and attending events, but we recommend it for everyone.

  • Any member receiving three or more ATV warnings or violations from a law enforcement official within one year, will have his/her membership privilege revoked for the period of one full year.

  • All members using town roads to access trails will travel at the town posted speed limit or less. Unless it is posted specifically for ATV's.

  • To keep the cleanliness of all trails - if you bring it in, you need to take it out.

  • Stay off from snowmobile maintained trails during snowmobile season.

  • If anyone is under 16 years of age, they must join under a parent.

  • Officers have the ability to amend the bylaws as need be or laws permit.

  • Officers will serve a maximum term of three years.

  • Prior to the end of year, and election of officers, the annual books will need to be audited.

 

501(c) (3) articles.

No part of the net earnings of the organization shall inure to the benefit of, or be distributable to it's members, trustees, officers or other private persons, except that the organization shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purposes set forth in the purpose clause hereof. No substantial part of the organization shall be the carrying on of propaganda, or otherwise attempting to influence legislation, and the publishing or distribution of statements for any political campaign on behalf of any candidate for public office. Notwithstanding any other provision of this document, the organization shall not carry on any other activities not permitted to be carried on (a) by an organization exempt from federal income tax under section 501 (c) (3) of the Internal Revenue Code, or (b) be an organization, contributions to which are deductible under section 170 (c) (2) of the Internal Revenue Code, or corresponding section of any future federal tax code.

Upon the dissolution of the organization, assets shall be distributed for one or more exempt purposes within the meaning of section 501 (c) (3) of the Internal Revenue Code, or corresponding section of any future federal tax code, or shall be distributed to the federal government, or to a state or local government for a public purpose. Any such assets not disposed of shall be disposed of by the court of common pleas of the county in which the principal office of the organization is then located. Exclusively for such purposes or to such organization or organizations, as said court shall determine, which are organized and operated exclusively for such purposes.
